1. Acceptance of Terms
By accessing, registering, or using the Platform, you agree to be bound by these Terms, along with all applicable policies including the Privacy Policy and Cancellation & Refund Policy.
If you do not agree, you must discontinue use immediately.
2. Eligibility
- You must be at least 18 years of age
- You must be legally capable of entering into a binding contract
- You agree to provide accurate and complete information
Resto reserves the right to suspend accounts with false or misleading information.
3. Platform Role
Resto is an intermediary technology platform that connects users with independent restaurant partners and delivery partners.
- Resto does not prepare food
- Restaurants are solely responsible for food quality, hygiene, and preparation
- Delivery may be handled by third-party or independent partners
4. User Account and Security
- You are responsible for maintaining confidentiality of login credentials
- You are responsible for all activities under your account
- Unauthorized use must be reported immediately
Resto shall not be liable for losses due to compromised credentials.
5. Order Placement and Acceptance
- Orders are confirmed only after acceptance by the restaurant
- Once accepted, the order becomes a binding transaction
- Resto may refuse or cancel orders at its discretion
6. Cancellation Policy (Reference Clause)
- Orders cannot be canceled after restaurant acceptance
- Cancellation and refunds are governed by the Cancellation & Refund Policy
- Repeated cancellations may lead to account restriction
7. Pricing, Fees and Payments
- Prices include applicable taxes unless stated otherwise
- Additional charges may include:
- Delivery fees
- Packaging charges
- Platform convenience fees
- Payments are processed via secure third-party gateways
Resto reserves the right to modify pricing without prior notice.
8. Delivery Terms
- Delivery timelines are estimates only
- Delays may occur due to:
- Traffic or weather
- Restaurant preparation delays
- High demand
Delivery Failure Conditions:
- Incorrect address → No refund
- Customer unavailable → Order treated as delivered
- Refusal to accept → No refund
9. User Conduct
Users agree not to:
- Provide false information
- Engage in abusive or harmful behavior
- Misuse offers or promotions
- Commit fraud or illegal activities
Violation may result in suspension or termination.
10. Promotions, Offers and Wallet
- Offers and coupons are subject to separate terms
- Resto may withdraw offers at any time
- Coupons may not be reinstated after cancellation
11. Intellectual Property
All content on the Platform including:
- Logos
- Design
- Text
- Software
are owned by Resto or its licensors.
Unauthorized use is strictly prohibited.
12. Accuracy of Information
Resto does not guarantee:
- Menu accuracy
- Availability of items
- Pricing correctness at all times
Restaurants may update information without notice.
13. Third-Party Services
The Platform may include integrations with third parties:
- Payment gateways
- External links
Resto is not responsible for third-party services or policies.
14. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis.
Resto does not guarantee:
- Uninterrupted service
- Error-free operation
- Accuracy of all content
15. Limitation of Liability
To the maximum extent permitted by law:
- Resto’s liability is limited to the order value paid
- Resto is not liable for:
- Indirect or consequential damages
- Food quality issues (restaurant responsibility)
- Delivery delays beyond control
16. Indemnification
You agree to indemnify and hold harmless Resto, its directors, employees, and partners from any claims arising from:
- Violation of these Terms
- Fraudulent activity
- Misuse of the Platform
17. Fraud Detection and Account Suspension
Resto may:
- Monitor suspicious activity
- Cancel high-risk orders
- Suspend or terminate accounts
No liability shall arise from such actions.
18. Force Majeure
Resto shall not be liable for failure or delay due to:
- Natural disasters
- Government restrictions
- Network failures
- Strikes or emergencies
19. Data Privacy
Your data is handled in accordance with the Privacy Policy available on the Platform.
20. Modifications to Terms
Resto reserves the right to modify these Terms at any time.
Continued use of the Platform constitutes acceptance of updated Terms.
21. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts located in Vijayapura, Karnataka, India.
